These terms cover your use of Écoute AI, a transcription service run by Katherine Cohen.
You own your recordings and transcripts. You give Écoute permission to store and process them only to provide the service. You're responsible for having the right to record and transcribe the people on your calls, including getting any consent the law where you and they are located requires.
Transcription is prepaid in hours of audio, billed by the second. Hours don't expire. If a transcription fails, the hours it held go back to your balance. Because hours never expire, purchases aren't refundable, with one exception: if you bought hours by mistake and haven't used any of them, email support@ecouteai.com within 14 days of the purchase and we'll refund it. The Zoom add-on is a monthly subscription you can cancel anytime from Settings; it stays active until the end of the period you paid for.
Transcripts and speaker names are produced automatically and can contain mistakes. Check anything important against the recording before you rely on it.
Don't use Écoute for anything illegal, to record people without the consent the law requires, or to try to break or overload the service.
Écoute is provided as is. We may change these terms or the service and will post updates here. If you stop using Écoute, you can export your transcripts first.
Écoute is provided "as is" and "as available." We don't promise it will run without interruption or errors, or that transcripts, speaker names, summaries or action items will be accurate or complete. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
To the extent the law allows, Écoute and Katherine Cohen aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities, arising from your use of Écoute. Our total liability for any claim related to Écoute is limited to the greater of what you paid us in the 12 months before the claim or $50. Some places don't allow these limits, so they may not fully apply to you.
If someone brings a claim against Écoute because of recordings you upload, how you use your transcripts, or your breaking these terms or the law, including recording consent laws, you agree to cover the resulting losses and costs, including reasonable legal fees.
You can stop using Écoute at any time. We may suspend or close an account that breaks these terms.
These terms are governed by the laws of the State of Arizona. Any dispute will be handled in the state or federal courts in Maricopa County, Arizona.
